SIGNIFICANT CHANGES TO THE FINES REGIME UNDER MANX ENACTMENTS

The Interpretation Act 2015, as amended by the Statute Law Revision Act 2017, made significant changes to the amount of fine which may be imposed on summary conviction for offences under Manx enactments.

The relevant provisions of the Interpretation Act 2015 commenced on 1 January 2018.

New Standard Scale of Fines

Section 55 of the Interpretation Act 2015 introduced a new standard scale of fines for offences punishable on summary conviction.  The standard scale may be amended from time to time and is to be construed and applied as it is from time to time amended.

Fines Specified in existing Manx Enactments

Any Manx enactment which was in operation on 1 January 2018 and which specified a fine or maximum fine amount on summary conviction is to be construed as though the specified amount is that given for the first level in the standard scale that is higher than the amount which was in force immediately before that date.

Therefore a specified fine or specified maximum amount on summary conviction prescribed in an existing Manx enactment is to be construed as shown in the table below.
